Terms and Conditions — ChqPlz

These Terms & Conditions govern your use of the ChqPlz mobile applications (iOS and Android) and website (chqplz.com.au). By accessing or using the Service, you agree to these Terms.

1. About ChqPlz

ChqPlz is a business-to-business (B2B) platform created by tradies. It enables Australian tradies and service businesses to anonymously share payment experiences and access publicly available insolvency information to help make more informed business decisions.

2. Eligibility

You must be:

  • At least 18 years old
  • A business owner, contractor, or worker in a trade or service industry
  • Legally able to enter into binding agreements

You are responsible for ensuring your use of ChqPlz complies with all applicable laws.

3. Your Account

To use the Service, you must create an account and provide accurate information. You are responsible for:

  • Maintaining the confidentiality of your login details
  • All activity under your account
  • Ensuring your information remains up to date

We may suspend or terminate accounts that violate these Terms.

4. Reports and User Content

4.1 Ownership

You retain ownership of the content you submit, including Reports. By submitting content, you grant ChqPlz a non‑exclusive licence to store, display, publish, and use the content for operating the Service.

4.2 Accuracy

You are responsible for ensuring that any Report you submit is:

  • Honest, accurate and based on your genuine business experience to the best of your knowledge.
  • Not defamatory
  • Not misleading
  • Not abusive or malicious

4.3 Reporter Confidentiality

ChqPlz never discloses the identity of the person who submitted a Report. Other users may see:

  • Job address
  • Customer phone number
  • Report details

…but not the identity of the reporter.

4.4 Prohibited Content

You must not submit content that:

  • Contains hate speech, threats, or harassment
  • Violates privacy laws
  • Includes sensitive personal information beyond what is required for a Report
  • Attempts to identify or dox another user
  • Contains viruses or harmful code

4.5 Community Standards

ChqPlz exists to promote responsible information sharing between businesses. Users must submit Reports in good faith and only where they have had a genuine business interaction with the customer or address being reported.

4.6 User Submitted Information

Reports published through ChqPlz are submitted by users based on their own business experiences. ChqPlz does not independently verify every Report and cannot guarantee the accuracy, completeness or current status of user-submitted information. Users should exercise their own judgement before making business decisions.

“Report” means information submitted by a user regarding their business experience with a customer or job address.

5. Use of the Service

You agree not to:

  • Interfere with the operation of the Service
  • Attempt to access accounts or data you are not authorised to view
  • Use automated tools (bots, scrapers) without permission
  • Reverse engineer or modify the app
  • Misuse Reports for harassment, discrimination, or unlawful purposes

We may restrict or remove access for misuse.

6. Third‑Party Services

The ChqPlz mobile apps and website rely on third‑party services to operate. These providers may collect data as part of their functionality. Use of these services is subject to their own terms and privacy policies.

Hosting & Infrastructure

  • Amazon Web Services (AWS) or equivalent cloud hosting

Analytics & Crash Reporting

  • Google Analytics / Firebase Analytics
  • Apple App Analytics

Maps

  • Google Maps SDK (Android)
  • Apple Maps / MapKit (iOS)

Payments

  • Stripe
  • Apple In‑App Purchases
  • Google Play Billing

Push Notifications

  • Firebase Cloud Messaging
  • Apple Push Notification Service

You acknowledge that these services are required for core app functionality.

7. Subscriptions & Payments (If Enabled)

If ChqPlz offers paid features or subscriptions:

  • Prices will be displayed in the app
  • Payments are processed through Apple or Google
  • All billing, refunds, and cancellations must follow App Store or Google Play policies
  • ChqPlz does not store your payment card details

8. Intellectual Property

All ChqPlz branding, logos, design, and platform features are owned by ChqPlz. You may not copy, modify, distribute, or create derivative works without permission.

9. Service Availability

We aim to keep the Service available at all times, but we do not guarantee:

  • Uninterrupted access
  • Error‑free operation
  • That Reports or data will always be available

We may update, suspend, or discontinue parts of the Service at any time.

10. Liability

To the maximum extent permitted by law:

  • Users remain solely responsible for any business decisions they make using information obtained through ChqPlz.
  • ChqPlz is not responsible for inaccurate or misleading user‑submitted content
  • ChqPlz is not liable for loss of business, profits, or data
  • Your use of the Service is at your own risk

Nothing in these Terms excludes liability where it cannot be excluded under Australian law.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Misuse the Service
  • Submit harmful or unlawful content

You may stop using the Service at any time.

12. Privacy

Your use of the Service is also governed by our Privacy Policy. The Privacy Policy explains:

  • What data we collect
  • How we use it
  • Third‑party services
  • Your rights
  • How to contact us

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app, website, or email. Continued use of the Service means you accept the updated Terms.
